Backrest position and time spent supine are critical risk factors for aspiration, increasing the risk for pneumonia. Empirical evidence of the effect of backrest positions on the incidence of ventilator-associated pneumonia, especially during mechanical ventilation over time, is limited. Objective To describe the relationship between backrest elevation and development of ventilator-associated pneumonia. †¢ Methods : It is a nonexperimental, longitudinal, descriptive design was used. The Clinical Pulmonary Infection Score was used to determine ventilator-associated pneumonia. Backrest elevation was measured continuously with a transdu cer system. Data were obtained from laboratory results and medical records from the start of mechanical ventilation up to 7 days. †¢ Results Sixty-six subjects were monitored (276 patient days).Mean backrest elevation for the entire study period was 21. 7 °. Backrest elevations were less than 30 ° 72% of the time and less than 10 ° 39% of the time. The mean Clinical Pulmonary Infection Score increased but not significantly, and backrest elevation had no direct effect on mean scores. A model for predicting the Clinical Pulmonary Infection Score at day 4 included baseline score, percentage of time spent at less than 30 ° on study day 1, and score on the Acute Physiology and Chronic Health Evaluation II, explaining 81% of the variability (F=7. 1, P=. 003). Although an evidence-based oral care protocol existed and best-practice oral care tools were available, the VAP rates had not significantly decreased even though nurses reported providing oral care. OBJECTIVES:The aim of the study was to determine if an evidence-based practice (EBP) educational program would improve the quality of oral care delivered to mechanically ventilated patients; thereby, reducing the VAP rate. RESULTS: Improvement in oral health was demonstrated by a decrease in median scores on the Oral Assessment Guide (pre (11. 0), post (9. 0)). A t-test analysis revealed a statistically significant difference (p=0. 0002). The frequency of oral care documentation also improved as demonstrated by a positive shift to the more frequent timeframes. Nurses in hospitals with an oral care protocol reported better compliance with hand washing and maintaining head-of-bed el evation, were more likely to regularly provide oral care, and were more familiar with rates of ventilator-associated pneumonia and the organisms involved than were nurses working in hospitals without such protocols.Literature Search5 †¢ Conclusions The guidelines for the prevention of ventilator-associated pneumonia from the Centers for Disease Control and Prevention are not consistently or uniformly implemented. John Constable

Constable, John – 1776–1837, English painter, b. Suffolk. Constable and Turner were the leading figures in English landscape painting of the 19th cent. Constable became famous for his landscapes of Suffolk, Hampstead, Salisbury, and Brighton. The son of a prosperous miller, he showed artistic talent while very young but did not devote himself to art until he was 23, when he went to London to study at the Royal Academy.Influenced by the 17th-century landscape painters Ruisdael and Claude Lorrain, his poetic approach to nature paralleled in spirit that of his contemporary, the poet Wordsworth. Constable's direct observations of nature and his free use of broken color were extraordinary in his day. He received but modest recognition in England, being tardily admitted to the Royal Academy in 1829. His work was more popular in France. In 1824, his View on the Stour (1819) and The Hay Wain (1821; National Gall. London) were exhibited at the Salon in Paris, winning gold medals . His work made a profound impression on the French romantics including the young Delacroix and Bonington. Later his painting influenced the Barbizon school and, more indirectly, the general course of French 19th-century landscape art. In the United States he is represented in the Metropolitan Museum and the Frick Collection, New York City, in the Mellon Center for British Art, New Haven, Conn. , and in the galleries of Philadelphia, Toledo, and Chicago.Splendid examples of his work are contained in the National Gallery, London and the Victoria and Albert Museum. African Americans Consequence Essay The African Americans played a major role before and after the Civil War, beginning from 1861 to 1870, which helped shape the course and consequences of the Civil War. In determining how African Americans shaped the course and consequences of the Civil War, one must assess how African Americans were given more opportunities. Politically, African Americans began to have a role in voting and to have the President and Republican Party fight for their full freedom. Socially, the African American’s class began to be looked at differently. Ideologically, the African Americans were being looked at as equal and made sure that people knew they were people too. Although African Americans had to continue to fight for their equality, they did, in fact, shape the course and consequences of the Civil War by having political, ideological, and social actions. African Americans had no rights to vote or involve themselves in politics but that changed after the Civil War. Giving African Americans the right to vote shaped the consequences of the Civil War by African American’s views being looked at as well. On August 1865, the Convention of the Colored People of Virginia was proceeded which claimed that since African Americans are free, they deserve to vote (Doc H). The African Americans spoke of being given suffrage, and then they were given the right to vote. This shaped a consequence of the Civil War because the African American’s views were no longer over looked. During the Civil War, no one J. Crespo P a g e | 2 paid attention to what the African Americans wanted but afterward, they were granted the voice to speak about what they wanted. After being heard and given the right to vote, the African Americans had participation in Constitutional Conventions. A map shows the following: the participation of African Americans and Whites in Constitutional Conventions during 1867-1868. (Doc J). Politically, the whites did not want to be overtaken by the African Americans, so they had a larger participation to overrule the African Americans. The whites wanted a powerful Democratic Party that supported their wanting. The African Americans still participated in the conventions to make sure the Republic Party was strong enough to continue to give the African American their rights. African Americans participating in the Constitutional Conventions shaped one of the consequences of the Civil War by not letting whites take over the political system. Not only did the African Americans have a consequence politically with being heard and not having white supremacy, politically African Americans were also given their freedom. African Americans were being given their freedom. Politically, African Americans were being granted a change in society. Abraham Lincoln published a letter on August 26, 1863 that proposed the following: the African Americans as a whole, everywhere, should be granted their freedom for they fought for the North (Doc C). Abraham Lincoln was trying to persuade the Whites to agree on freedom for the African Americans in the United States. African Americans were being freed everywhere instead of just the North. Politically, this helped the African Americans tremendously because they were going to be freed everywhere. One of the consequences was African Americans being freed in the North, but then African Americans were going to be freed everywhere, including the South. After the letter sent out by Abraham Lincoln, the Republican Party decided to try to get an amendment that freed all African Americans. In 1864, the Republican Party’s platform stated the following: they wanted an Amendment to J. Crespo P a g e | 3 officially end slavery everywhere (Doc D). Politically, the African Americans were beginning to be seen as people throughout the nation. This consequence after the Civil War proved that African Americans were no longer going to be slaves anywhere. African Americans found their freedom with the help of the political power of Abraham Lincoln and Republican Party. Then the African Americans were socially looked at differently. The African Americans were no longer such a low class because people began to look at them differently and notice the good things about African Americans. Socially, the African Americans were being helped by the people. On July 30 1861 General Benjamin F. Butler reported to the secretary of the war stating the following: the African Americans should be free since they are a part of the North (Doc A). Socially, the North no longer presented the African Americans as property. This shaped the Civil War because the African Americans became part of the Union that fought for the North. Then after the Civil War was won and the African Americans were freed, their school system proved them socially equal and good as the whites. In March 1864, Charlotte Forten, an African American teacher in South Carolina Sea Islands, said the following: she spoke of how happy the African American children were to learn and how much knowledge they have attained (Doc E). Socially, the African Americans were no longer looked at as less smart than the Whites. The consequence of the Civil War with the African Americans socially with schools showed their equality to whites. Socially, the African Americans were no longer looked at as slaves or less knowledgeable. The African Americans, ideologically, were no longer looked as property. The African Americans were beginning to be looked at the same as the whites. The African Americans no longer were looked at as property. Ideologically, the African Americans caused a consequence of the Civil War to be looked at as people. On March 7, 1864 in The New J. Crespo P a g e | 4 York Times it stated the following: African Americans have gone through a drastic change to now be free Americans in the United States equal to the whites (Doc F). The African Americans were no longer the property they were once known of; African Americans were people just as the Whites. Ideologically, this proved that a consequence of the Civil War was the change of equality that African Americans had. After The New York Times had posted the article, Thomas Nast from Harper’s Weekly on August 5 1865 had posted the following: a picture of lady liberty standing next to an African American Union Solider asking â€Å"And Not This Man? † (Doc G). Ideologically, the picture proved that the people no longer were going to look at African Americans as property so they should be treated equal. The North wanted the South to have the same thoughts about African Americans. This set a consequence of the Civil War by having the African Americans no longer being looked at as slaves as they were when the war had begun. After the African Americans were no longer looked at as property, the African Americans made sure the Whites thought of them as people no matter what. African Americans were going to deal with racism and injustice but they made sure that the whites knew they were people also. Ideologically, the African American consequence after the Civil War was that African Americans are people, not slaves nor property. On August 20 1862 in New York during the resolution of African Americans in Newtown, African Americans stated the following: they wanted to make sure that the President knew that they were not going to leave because the United States was their country also that they were going to fight in for their freedom (Doc B). This constructed the course of the Civil War because the African Americans began fighting in the Civil War. Ideologically, African Americans were looked at as people in the nation of the United States to fight along the Whites for their freedom and country. After the Civil War, when African Americans were no longer slaves and granted their freedom, some J. Crespo P a g e | 5 whites resisted the full freedom of African Americans. In 1867 with Rebecca Parsons she went through the following: she went back to receive her kindred since she was a free slave but the owner would not allow her to because they were â€Å"his† (Doc I). Although, Parsons did not allow Rebecca her children it proved that Parsons realized she was also people because she demanded them back from him. Rebecca is no longer a slave who has to stand down, she also had rights which proved she is as equal as Parsons. Ideologically, after the Civil War this was a consequence by African Americans no longer being looked at differently because they were people also. African Americans ideologically created the course and consequence of the Civil War by being looked at as people and not slaves. African Americans shaped the course and consequences of the Civil War by ideological, social, and political reasoning. African Americans were known in the United States as slaves and property but they no longer were during and after the Civil War. They became people of equality to the whites in the United States. They no longer had no say in politics; they were given rights and opportunities to speak of their views. They no longer were viewed as property but people. Conceptual- in this method the researcher need to rely on the existing data and interpret the existing data or develop new theories, which help the researcher to get the solution to the research problem. Quantitative- in the quantitative method the data collected is based on the numerical data . the method depends of mathematical calculations and the statistical reports. The results are in numerical number. Some of the statistical terms used in this type of research method are mean, median, etc. Qualitative- the results for the qualitative analysis prepared on the basis of facts of on the basis of the trend in the chosen sample size. It is not based on the numerical data and it depends on the quality of the chosen sample or colour of the chosen sample ( Saunders M, Lewis P and Thronhill A, 2007) In the given research problem we can choose any of the above defined research methodology. Let us assume we are going to use the quantitative analysis for this research problem. Data collection methods It is the term used to represent the way to collect data related to the research problem. There are two types of data type primary data and the secondary data. The way in which the data collects decides whether the data is primary or secondary. In the research problem we can use the primary data. There are many ways to collect the primary data. The different ways to collect the primary and secondary data are described in the following paragraphs. Ways to collect the primary data There are many different ways that a researcher can make use to gather the primary data. Primary data is the data which comes directly from the sample size. The nature and accuracy of the collected data depends on the method of data collection and the selection of the sample size and location of the research. The different methods to collect the primary data are observation, interviews and printed or mailed questionnaires. Observation method à ¢Ãƒ ¢Ã¢â‚¬Å¡Ã‚ ¬ in this method the researcher observes a limited sample size and findings are made on the basis of the observation. It is suitable when the researcher has a very limited number of samples and has enough time to finish the research. Interviews- by this method, the researcher directly or indirectly asks a set of predefined questions to the interviewee and the gathered data is used for the analysis purpose. The researcher can either conduct direct or telephonic interview with the interviewee and it is necessary for the researcher to prepare a set of questions which is related to the research topic. This method is also suitable when the chosen sample size is small. Questionnaires à ¢Ãƒ ¢Ã¢â‚¬Å¡Ã‚ ¬ this method of data collection suitable when the researcher need to collect a large number of data. The researcher needs to prepare a questionnaire and answers for the questions should be a one word or the researcher needs to provide a set of options from which a person can choose. Nowadays we can see the researchers use free websites or online tools (for example survey monkey website) to gather the data or the researcher may email the questionnaires to the participants email address. In the research problem we can use the questionnaire method to collect the data from the participants. Ways to collect the secondary data We can gather the secondary data by making use of the existing information or by referring the previous researches conducted by a trusted person or even we can make use of the reports of some trusted sources. For example sometimes it is necessary for the researcher want to know the profit earned by a company in a short period time and in this case we can say that the companyà ¢Ãƒ ¢Ã¢â‚¬Å¡Ã‚ ¬Ãƒ ¢Ã¢â‚¬Å¾Ã‚ ¢s annual report is an example for the secondary data source. In the research we can choose the quantitative analysis as the research methodology and questionnaire as the way to gather the data from the sample size. Set the sample size and location for the data collection The researcher needs to find a sample size which should represent the entire population and should be capable of producing an unbiased result for the research problem. The researcher can not include the entire population in the sample and can randomly choose items from the large population. In the give n research problem we can choose the sample size as 50 people from the population. The sample should contain employees working for the branded organisations and fresh graduates who all are looking for job. In the questionnaire we can include questions related to measure the effectiveness of the retention techniques and the employer branding. In the questionnaire the researcher can include both the popular employers and unpopular employers. For instance the researcher can asks the participant about the organisations which would they likes to work with. In the research we can classify the sample size 50 into 25 employees from the people working in the Sainsbury and 25 from the local people of the selected area. The researcher can approach the above mentioned set of people from the population. It is necessary for the researcher to prepare a schedule for the data collection and can choose a particular location for the data collection. Set timetable for the data collection activities. It is necessary for the researcher to set a date and a time for the collection of data related to the search. By doing this the researcher can track the number of days taken for each activity in the research. Chapter 4 Data analysis and findings After the collection of the data, the researcher needs to evaluate the collected data. The researcher can categorise the data on the basis of age, work and sex and can prepare the information on the basis of that. For example in the current research if we apply the data analysis we may get results similar to that of the following. Out sample size is 50.25 males participated in the survey or 40 people love to work with the branded employers.In this stage the researcher can avoid the unwanted samples from the sample collection and remove the samples which seem to avoid the occurrence of an unbiased result. After the data analysis process, the researcher gets the real data required for the research. Methods to reveal the research findings Once the researcher filtered the collected data, it is necessary to display the findings with the help of some graphs or charts. The common tools used in this method are the scatter diagrams, bar charts and pie diagrams. Sometimes it is necessary for the researcher to use some statistical calculations like mean, median, correlations and graphical displays such as scatter diagrams or regression analysis graphs. As we have chosen the quantitative analysis method and questionnaire method we can make use of some diagrams to represent the findings of the research. For example we can use pie diagrams or bar charts to represent the number of respondents for a particular question. In the case of qualitative analysis, the researcher can use some tabular forms to compare the features of the sample. Chapter 5 Scope of the research In the given research, the researcher has limited the size of the sample to 50 people and the result of the research based on the responses from the chosen sample. The researcher needs to choose the sample to get an unbiased solution to the research problem. In the research, the researcher have chosen 25 employees from the Sainsbury supermarket and 25 people from the public and the data collected from these two groups using the questionnaires. Ethical issues In this section the researcher needs to give much importance to the privacy of the participants in the data collection methods. In the research, the research does not want to collect any personal information from the participants. If the researcher has the details of the participants, the researcher has no rights to use the data with out the consent from the respective person. According to Resnik B D ,the persons who all participated in the data collection method should be independent of the influence of any third parties and the researcher needs to give equal opportunity to all to participate in the data collection process (Resnik B D, 2009). Preparation of research schedule using the Gantt chart According to Barkley B T, the researcher can make use of the Gantt chart to identify the length of the whole research process. It also the researcher to break down the research in to different processes and shows the effective ways to finish the research in time. It shows how the researcher can carry out more than one task at a time (Barkley T, 2006). In the given research also if we apply the Gantt chart, we can break down the processes in to different parts and allocate a particular time schedule for them. it helps the researcher to conduct more than one process at the same time. Conclusion: The report helped me to identify the importance of channels of communication and it gives me insight of how communication play vital role and can be improved and I can make use of these learned things n my final dissertation.

With President Bush in office, the social work community knew it was in for big changes. Armed with an agenda consistent with his conservative beliefs, President Bush came forth with policies that attempted to downsize the federal role in social issues and social work, to return power to the states in the form of block grants, and to increase reliance on the market as a solution to problems. Like his father before him, Bush wanted a return to a time when helping a neighbor was something one did out of the goodness of the heart. To make the tax cuts he promised happen, Bush had to shave dollars from the welfare programs administered by social workers to the nation’s most downtrodden citizens. With support for faith-based social service agencies, a taste for private school vouchers, and an incessant urge to privatize what is known among policy analysts as the â€Å"third rail of politics† (Social Security), President Bush was able to stir up a long-standing debate within the social work community (Zastrow, 1999). Disability Discrimination, Employment Law Introduction            The employment law governs the duties and rights between employees and employers and are also referred as labour law. The rules are largely designed to keep the workers safe as well as ascertain that they are treated reasonably within the workplace. In addition, the Employment Laws are also enacted to protect the employer’s interest. In a nutshell, Employment Laws are based on national and state charter, administrative rules, court opinions and legislation. As mentioned earlier, a particular employment relationship can be governed by a contract between the employer and the employee. For example, the American Employment Act traces back to the community protest, in opposition to the unfair practices during the industrial revolution in the 20th century. The initial laws were enacted to compensate the injured workers, outlaw child labour and establish minimum wage for the workers. However, the law has been expanded to cover other aspects faced in the contract of employment (Davies, 2012).            Employment discrimination laws are the federal and state laws which usually prohibit employers from treating the workers differently in reference to certain attributes. Discrimination by government employers ‘for example’ violates the constitution guarantee of equal protection. Under the current law, persons are protected against unfairness based on aspects such as their skin colour, race, country of origin or genetic information (such as family medical history), gender, disability, religion or age. In several cases, it is also unlawful for employers to show favouritism based on political affiliation, sexual orientation or marital status.            What is discrimination? Labour market discrimination is referred as the difference in the treatment of two qualified individuals job applicant or workers on account of their disability, religion, race, gender, etc. It is the main source of inequality in the workplaces. Discrimination is harmful as it affects the economy outcomes of business entities, organizations, and that of equally productive workers. This can either be directly or indirectly. Discrimination is not only about measurable outcomes but also involves unquantifiable outcomes. However, at some points it becomes hard to differentiate between productivity relate inequality at the workplaces and discrimination. However, over the time, employment inequalities have declined but the vital issue on employment discrimination is the persistence of the vice (discrimination) in the capitalist economy.            In employment law, direct discrimination is decisions such as the failure to hire, unequal pay and benefits, firing of workers that are based on an applicant’s or employees characteristics such as colour, gender, religion disability among other characteristics. Indirect discrimination is when discrimination arises from employment policies issued by the employer. The policies have an adverse effect on the employee’s race, colour of their skin, ethnicity and other like characteristics. For example, when an organization has all the facilities and can be accessed by all the workers including the disabled, but access to the building by the disabled workers is from the back side of the building; then this is a form of indirect discrimination. Direct discrimination is when two different people ‘for example’ a white and black with the same qualification apply for a job vacant. The black person is told the job was taken, but when the white applies , the response is different, and the job is available. Disability discrimination            Disability discrimination is a form of discrimination in workplaces where a manager or other body covered by the Association for people with Disabilities Act, treats an employee or an applicant with a disability in an unlawful way. It is also giving harsh treatment to an individual only because he is disabled. On the other hand, disability inequity also occurs when a covered employer or other entity treats an employee or applicant less favourably because he or she has an account of a disability. Disabilities may involve cases such as cancer that is inhibited or in reduction and also cases such as mental or a physical mutilation. (Mutilation that is not short-lived such that it is expected to last or lasting for 6 months or less). The labour law ‘however’ requires an employer to supply rational accommodation to such a worker or a job aspirant with any form of disability. Despite this, there is an exceptional for such provision. In case doing so would ca use major complexity or expenditure to the employer (undue hardship), the employer is permitted to neglect the Employment Law (Geisen & Harder, 2011).            Under the equality Act 2010, disability discrimination by an employer is when he or she treats a job applicant or an employee’s less favourably because of his or her disability. For example, job is a qualified accountant and applied for the job of chief accountant officer in company A. However, his application was turned down after; the management learnt that he is on a wheelchair user. This is direct disability discrimination. When an organization has a policy or procedure which despite applying to all the workers in the entity, puts people who share disability at a disadvantage compared to others, it is referred as indirect discrimination. Direct discrimination is more prominent in comparison with indirect. It is mostly experienced when a person is discriminated in the following areas; employment, education and training, provision of facilities, goods or services among many other areas (Perry et al, 2004).            There are various sources of Employment Law or the labour law both at international and national level. It can be found in a number of different sources. One of the main sources is the Common Law. This is the law made by judges when announcing their judgment in cases. Common Law is different from the Legislation law. Secondly, there is the Legislation source of the employment laws which is also known as Acts of Parliament or Statute law. These are laws drafted and enacted by the government. For example under the Employment law, there are Employment Act 2008, Employment act 2002, Employment rights Act 1996. Others include; Disability Discrimination Act 1995 and 2005, human rights act 1998, Equality Act, 2006 among many other acts that are used to govern the employment contracts ‘as well as sources of Employment law’. What is contained in the different Act may differ from one country to another. Government agencies Contribution in preventing disability discrimination            Government agencies in the UK, has been known for their commitment to social justice for all the people. This has been through various ways such as access of vital information to all people. The government has embarked on the implementation of the United Kingdom employment equality law. This is a body of which legislates against prejudice based actions in the workplaces. The law has well stipulated guidance in prevention of discrimination against the defined characteristics such as disability. In addition, the government has a well established court system that has allowed disability discrimination victims to report in case of any discrimination experience. The government has been on the forefront in fighting against discrimination. This been seen through the support of agencies such as human rights movement. The movement is allowed to fight for the rights of minority groups in the community. The government has also supported the fight against disability discrimina tion through the Disability Discrimination Act (DDA). The act makes it criminal to categorize against disabled persons. The law was enacted in1995 to provide stability in employment. The U.K. government has since extensively improved the DDA’s reward by extending its extent to award disabled persons lawfully protected social rights in almost all decisive areas of life (Mabbett, 2005). Contribution of human rights in disability discrimination            Since the founding of the human rights movement, the establishment has been on the forefront in promoting fundamental human rights. The establishment has been and continues to fight for equality as this is the cornerstone of fighting all kinds of discrimination. The project of fighting disability discrimination has been through the collaboration of the government and the human rights organization as well as like minded establishment. However, the fight against disability discrimination has its advantages and disadvantages. One of the advantages is the peaceful existence of people in the places of work. Whether disabled or not, the extinction of discrimination in the work places makes it possible for each and every employee contribute positively to the running of the organization. In addition, the fight has led to minimized discriminations against disabled people. It also provides vital egalitarianism through equal rights in service. Finally, it makes easy access of goods and services to all people such as public transport, education among others, as well as providing optimal conditions for retaining and hiring qualified workers (Hunter, 1992).            However, the fight against disability discrimination has resulted to increased expenses for the organization and business entities. For example, the employer is supposed to provide adequate resources for the disabled to have equal access as the other workers. If workers is confined into a wheelchair, his mobility is limited, the employer is supposed to provide adequate facilities and structures to enhance such a worker movement. This calls for extra financial need to support the disabled people. Disability discrimination cases at work place. (Case 1)Case Summary            Joan Maya (the plaintiff) worked for Sweet Restaurant Limited. She sued her former employer Sweet Restaurant Limited for direct disability discrimination. Despite Sweet Restaurant Limited (the defendant) not making explicit remarks about Joan’s disabilities when terminating her employment, the court found that, the reason behind Joan’s dismissal was her injuries. In turn, the court ruled in favour of Joan and awarded damages for injuries and loss of income. Facts            Joan was employed by the Sweet Restaurant Limited as a waiter in its Liverpool restaurant. She was supposed to help wheelchair-bound customers by lifting the right side of the wheelchair using his left hand together with three other waiters. On 30th April 2010, Joan sustained an injury to the left side of her body while supporting a wheelchair-bound customer. The Employees’ Compensation (Ordinary Assessment) Board Sweet Restaurant Limited assessed that Joan had suffered a 1 percent loss in earnings capacity as a result of that injury. However, Joan alleged that the Defendant had engaged in unlawful disability discrimination in breach of the Disability Discrimination Ordinance (DDO) on the grounds that: The Defendant delayed or defaulted in reimbursing medical expenses to Joan. Mr. Walter, a manager of the Defendant, displayed a ferocious facial expression to Joan. Walter was dissatisfied when Joan asked to hold the left side of the wheelchair (instead of the right side) due to her injury.            Mr. Victor John, a director of the Defendant, had expressed dissatisfaction taking her sick leave. He showed a judgmental facial expression to Joan, yelled at her and directed her to leave Sweet Restaurant Limited for her inability to use her left hand to carry the wheelchair. The Defendant dismissed Joan with 7 days’ wages without notice and giving no reason. The Defendant denied the accusation of illegal discrimination. It argued that Joan was already well again from his injuries at the material times, and sought to base Joan’s dismissal on her poor work presentation. Decision            The Court alleged that, the complaints made against Joan’s work performance were unconfirmed because: No warning in print had been issued about Joan’s poor performance. I addition, there is no record of Joan’s attendance had been produced by the Defendant to show that Joan had intentionally selected the busiest dates to take leave. The conditions indicated that the reason for Joan’s discharge was not her deprived performance, but the soured affiliation between the parties. This was after she had her injuries. Despite the fact that no remarks were made by Walter or Victor that pointed directly at her disabilities, the Court concluded that the disgust they directed against Joan was as a result of the work injuries Joan had sustained. The Court held that the Defendant had acted in breach of the DDO and awarded damages to Joan of $101,181.70 comprising compensation for injuries sustained and her loss of earnings. Comments from the case            It is illegal to treat a worker less satisfactorily on the grounds of the employee’s disability. An employer does not need to have made any explicit remarks about an employee’s disability to engage in unlawful disability discrimination. As such, an employer needs to be careful about how it treats an employee who has a disability or who may have suffered an injury. The explanation of the case was based on the Disability Discrimination Act (DDA), which is the major law concerned with discrimination cases. The act is used to define disability in context to the case scenario. However, despite the well laid law in prevention of disability discrimination (direct discrimination), the implementation of justice has challenges which is identification of evidences to support the cases.            There has been the enactment of disability prevention policies which are directed at controlling and minimization of discrimination cases. The policies are usually contained in the law with well stipulated procedure for employees and employers. There has been a shift away from treating disabled persons as passive recipients of welfare to viewing them as people with rights and the capacity to control their own care. The disabled people’s society, in campaigning for an inclusive community, is highly decisive of the form that recent government policy on anti-discrimination has taken. The employers are always supposed to adhere to the rules and regulations of the law about any form of discrimination. (Reitz, 2007).The process of employment law enactment has been faced with numerous challenges. One of the main challenges is the difference in policies from that are implemented by various organizations and employment companies in curbing organizations. Despite the general law against the disability discrimination ‘as well as other forms of discrimination’ different organizations have various approach method in curbing the vice. This greatly the common goal of the discrimination eradication acts. In addition, the reluctance of the people in the country has contributed to fully enactment of the law. This is whereby employees fail to report discrimination cases to the courts. This has in turn become a stumbling block in the fight against employee discrimination. Another challenge in curbing discrimination is the lack of information and educates education on the matter (lack of knowledge to the people). Education programs are frequently organized to educate not only the employees but also the general public on ways to eliminate discrimination.            The employment law and legal institutions have to the change of the social interaction between the law and society. The employment law has contributed to the social understanding and existence of different people in work places. In other words, the law has created equality in the society. Law has, more often than not, been measured as the conventional approach of the state to manage and uphold social order within its domain. It is also taken as a mechanism to successfully promote and uphold regulations in the societies. Laws and regulations are generally constructed on lawful concepts that emerge for centuries all through time, and they are influencing everyday life in varying ways. If we, for theoretical purposes, understand the law as a system of rules, the relations between law and society has until recently been both fairly straightforward and based on customs, traditions, geographical boundaries and physical space. Conclusion            The employment law and measure remains important features of employment regulation. Employers are much less likely to determine policies or employment practices without reference to legal standards. Nevertheless, there is still achievement which has been attained in curbing various levels of discrimination among the workers. Disability discrimination however, requires efforts from various stakeholders in order to minimize the discrimination in workplaces. The adoption of the legislation setting into the employment laws has improved labour standards and in turn strengthens the workers as well as their unions. The designing of labour laws today also has a key position in ensuring that a high level of employment and sustained economic growth is accompanied by continuous improvement of the living and working conditions globally.
